Terms of Service

Welcome to PointsAssessment. These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or "Customer") and TM Profits Solutions Ltd, a company organized under the laws of the Republic of Cyprus, registered at Andrea Araouzou 2, Stefano Plaza, 1st floor, Flat/office 101, Kato Polemidia, 4150, Limassol, Cyprus, and operating the brand PointsAssessment ("PointsAssessment," "we," "us," or "our"). By purchasing or using our service, you agree to these Terms. If you do not agree, do not purchase or use the service.
1. The service
PointsAssessment provides a Points Strategy Assessment: a paid consultation in which you speak with Claire, our AI Card Strategist, by phone for approximately 20–30 minutes about how your business spends money and what you want from credit card rewards (the "assessment call"). After the call, we produce a personalized written assessment that recommends credit cards suited to the spending profile you described, along with informational links to apply for those cards. Every assessment is reviewed by a member of our team before it is sent to you. Assessments are normally delivered by email within 48 hours of your call.
The service is an educational and consulting product. It is informational only.
Who the service is for. The Points Strategy Assessment is offered only to business owners and businesses located in the United States, for business purposes. It is not intended for personal, family, or household use, and we do not offer or market the service to consumers in the European Union, the United Kingdom, or the wider European Economic Area. By purchasing, you confirm that you are a US-based business owner (or are authorized to act for a US-based business) and that you are using the service for business purposes.
2. Fees and payment
The Points Strategy Assessment is a one-time fee, charged at the time of booking. The current price is shown to you at checkout before you pay, and the fee you pay at booking is the price that applies to your assessment. Payment is processed by our third-party payment processor (Stripe). There is no recurring charge and no additional fee for your assessment or for routine follow-up questions about it. We may change our pricing for new customers at any time, and we may offer additional paid services in the future; those will be priced and described separately and are not included in your assessment fee.
3. The 7-Day Money-Back Guarantee and refunds
Our 7-Day Money-Back Guarantee: If, after receiving your written assessment, you don't feel it was worth what you paid, email us within 7 days. We may ask a couple of questions to understand your situation and see whether there's something we can make right first — and if your assessment genuinely wasn't worth it to you, we'll refund you in full.
To claim the guarantee, email hello@pointsassessment.com from the address associated with your booking within seven (7) days of the delivery of your written assessment. We may ask reasonable questions to evaluate the request. We aim to process approved refunds to your original payment method within 5–10 business days. After the 7-day window has closed, the fee is non-refundable. This refund right is in addition to any rights you may have under applicable consumer-protection law.
What the guarantee does and does not promise. This is a satisfaction guarantee. It is not a promise that you will be approved for any card, or that you will earn, save, or realize any particular amount or multiple. Any value figures in your assessment are illustrative projections of *potential* rewards — what you ultimately realize depends on your real spending, the cards you are approved for, issuer terms, and how you use your cards, all of which can change and are outside our control.
4. Not financial, investment, tax, or legal advice
PointsAssessment is a publisher and consulting service. We are not financial advisors, investment advisors, tax advisors, credit counselors, or attorneys, and we are not registered as any of those. The Points Strategy Assessment and the written assessment educate you about credit card rewards strategy. Nothing we provide is financial advice, investment advice, tax advice, legal advice, or credit-repair or credit-counseling services. Card recommendations are informational and reflect general rewards strategy based on the spending information you provide; they are not a directive to take any specific financial action. You are solely responsible for your own financial decisions. For advice about your taxes, debt, credit, or overall finances, consult a licensed professional in the relevant field.
5. No guarantee of card approval or specific results
We do not issue credit cards and we do not control card approval decisions. Whether you are approved for any card depends on the issuer's own criteria, your credit history, your income, and other factors outside our control. We do not guarantee that you will be approved for any card we recommend. We also do not guarantee any specific amount of rewards, points, cash back, or savings. The value any business actually realizes depends on its spending, its card usage, issuer terms, and reward program changes, all of which can change at any time. Any figures or ranges we mention are illustrative estimates, not promises. Our refund policy in Section 3 is your remedy if you are not satisfied with the assessment.
6. Claire is an artificial intelligence
Claire is an automated artificial-intelligence voice agent, not a human being. Your assessment call is conducted by AI. We disclose this clearly before and during your call, and Claire will confirm she is an AI if you ask. We make this disclosure both as a matter of honesty and to comply with applicable bot-disclosure law, including the California Bolstering Online Transparency Act (California Business & Professions Code §§ 17940–17943, "SB 1001"), which requires that automated online accounts used in commercial communication identify themselves as bots. A human — a member of our team — reviews every assessment before it is sent to you.
7. Call recording and consent
Your assessment call is recorded and transcribed so we can produce your assessment and review it for quality and compliance. By proceeding with the call after being notified, you consent to the recording and transcription of the call. If you do not consent to being recorded, do not proceed with the call and contact hello@pointsassessment.com for a refund. See our Privacy Policy for how recordings and transcripts are stored, used, and retained.
8. Affiliate relationship disclosure
PointsAssessment participates in credit card affiliate and referral programs and may earn a commission when you apply for or are approved for a card through links in our assessments, emails, or website, at no extra cost to you. Commissions do not influence our recommendations. Our full Affiliate Disclosure is incorporated into these Terms by reference.
9. Acceptable use
When you use our service, you agree that you will: - provide accurate and truthful information during your assessment; - use the service for your own legitimate business or personal purposes; - not resell, white-label, or commercially redistribute our assessments or Claire's conversation without our written permission; - not attempt to disrupt, reverse-engineer, scrape, or overload our systems or Claire; - not use the service for any unlawful purpose, and not abuse, harass, or threaten our staff or our AI agent.
We may decline service, suspend access, or terminate this agreement (with a refund where required by Section 3 or by law) if you breach this section.
10. Intellectual property
The assessment we deliver is licensed to you for your own use. PointsAssessment retains ownership of its templates, card knowledge base, the Claire agent, and all underlying methods and software. You may share your own assessment with your accountant or business partners, but you may not publish or sell it.
11. Limitation of liability
To the maximum extent permitted by law: the service is provided "as is" and "as available," without warranties of any kind, express or implied. PointsAssessment is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost rewards, lost points, or lost opportunities, arising out of or related to the service. Our total aggregate liability to you for any claim arising out of or related to the service will not exceed the amount you actually paid us for the assessment.
Time limit on claims. Any claim or dispute you bring against us arising out of or relating to the service must be started within three (3) months of the date of the event that gave rise to it. After that period, the claim is permanently barred and may not be brought.
12. Indemnification
You agree to hold PointsAssessment harmless from claims arising out of your misuse of the service or your breach of these Terms, to the extent permitted by applicable law.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-law rules, and the courts of Limassol, Cyprus will have jurisdiction over any dispute arising out of or relating to these Terms or the service. Nothing in this section deprives you of the protection of any mandatory consumer-protection law of the country or US state in which you reside — if you are a consumer, you may also be entitled to bring proceedings, or to the protections available to you, in your home jurisdiction, and this clause does not waive those rights. We encourage you to contact us first at hello@pointsassessment.com so we can try to resolve any concern informally before either of us starts formal proceedings.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above and, for material changes, make reasonable efforts to notify customers by email or a notice on our website. Changes apply to purchases made after the changes take effect; they do not retroactively change the terms of an assessment you already purchased.
